Often there is confusion when the question arises if a person can use CBD products while having a CCL so we are hear to try to shed some light on some common misconceptions as laws can be, well confusing to say the least. Let's dive in.


Can I have a CCL & consume CBD products?

Yes, you can have a Concealed Carry License (CCL) and use CBD products. CBD (cannabidiol) is a non-intoxicating compound found in cannabis and hemp plants, and it is legal under federal law as long as it contains less than 0.3% THC (tetrahydrocannabinol), the psychoactive component of cannabis.


Having a CCL primarily pertains to your ability to legally carry a concealed firearm, and it does not typically restrict your use of legal hemp-derived products like CBD. However, it's essential to be aware of the specific laws and regulations in your state regarding cannabis and hemp products, as these can vary. In states like Illinois, where both medical and recreational cannabis are legal, understanding the distinctions between CBD derived from hemp and CBD derived from cannabis with higher THC levels is crucial.


It's advisable to purchase CBD products from reputable sources to ensure they comply with legal standards and contain the advertised amount of CBD and minimal THC. If you have any concerns about how CBD use may interact with your CCL or other legal considerations, consulting with legal experts or regulatory authorities can provide clarity based on the specific laws in your jurisdiction.


Concealed Carry License

According to the Illinois State Police department: "On July 9, 2013, Public Act 98-63, the Firearm Concealed Carry Act became state law (430 ILCS 66). This law requires an Illinois Concealed Carry License to carry a concealed firearm in Illinois.


Please Note: If you possess a Medical Marijuana License, are a caregiver pursuant to the Compassionate Use of Medical Cannabis Pilot Program Act, and/or otherwise use cannabis consistent with Illinois law, your FOID card or CCL will not be revoked nor will your application(s) denied. Medical Marijuana Licenses are state-issued and cannot result in the denial of any right or privilege. However, under Federal law, you are subject to restrictions that prohibit you from acquiring or possessing firearms and firearms ammunition. These restrictions are pursuant to the Gun Control Act of 1968, specifically 18 U.S.C. §922 and remain in effect until the revocation or relinquishment of your medical cannabis card or until one year after you last used cannabis, whichever is later".


So we listed the details to the law above, however, these are the laws according to the use of marijuana, but this blog is about the use of CBD. What's the difference you ask?


What is Marijuana?

Marijuana, also known as cannabis, is a psychoactive drug derived from the Cannabis plant. It contains compounds called cannabinoids, with delta-9-tetrahydrocannabinol (THC) being the primary psychoactive ingredient responsible for its effects. When consumed, typically by smoking or ingesting, marijuana can induce feelings of relaxation, euphoria, altered sensory perception, and increased appetite. It has been used for medicinal purposes to alleviate symptoms such as pain, nausea, and muscle spasms, and is also used recreationally for its mind-altering effects.


The legal status of marijuana varies worldwide, with some regions legalizing it for medical and/or recreational use, while others maintain strict prohibitions. In certain cities and states you need a Medical Marijuana Card to purchase marijuana products, which requires you to register with the state.


What is CBD?

CBD, or cannabidiol, is a non-intoxicating compound found in cannabis and hemp plants. Unlike THC (tetrahydrocannabinol), CBD does not produce a "high" or psychoactive effect. It is known for its potential therapeutic benefits, which include alleviating anxiety, reducing inflammation, relieving pain, and promoting relaxation. CBD interacts with the body's endocannabinoid system, which regulates various physiological processes such as mood, pain sensation, appetite, and sleep. CBD is commonly consumed in the form of oils, edibles, capsules, creams, and other products, and it has gained popularity for its natural approach to enhancing wellness without the mind-altering effects associated with marijuana. It is legal under federal law if derived from hemp containing less than 0.3% THC, though regulations vary by state and country.


While generally CBD is not psychoactive, there are products that fall under the Hemp Bill (such as Delta 8 & Delta 9) that can produce psychoactive effects so it's always important to educate yourself on the products you are taking so that you know what kind of effects to expect. The reason psychoactive hemp products remain legal under the Hemp Bill is because they are to always be under 0.3% THC by dry weight or volume. You do not need any card or to be registered with the state in order to purchase hemp and CBD products.


In a nutshell

The only reference to cannabis products concerning a CCL pertains specifically to marijuana, not CBD. Of course we would always advise to stay abreast of the laws in your area as laws continue to change for both gun laws, cannabis laws, & hemp laws.
